(“we” or “us” or “ClarityPay”) provides a point-of-sale financing platform that connects lenders (“Program Lenders”) and merchants that enable this technology (“Merchants”). ClarityPay provides technology and support services facilitating Program Lenders’ lending programs (the “Platform”). ClarityPay is not a bank, lender, or other financial institution, and we do not make credit decisions or extend credit. Please note that for ClarityPay text and mobile programs, the following terms apply:   The mobile carriers are not liable for delayed or undelivered messages. Additionally, ClarityPay reserves the right to alter message frequency at any time (i.e. we may change the frequency of texts that you receive under our SMS programs). We will notify you via text if we change the frequency and provide you with the opportunity to opt out. In the event that you change or deactivate your mobile number it is your responsibility to notify ClarityPay at support@claritypay.com to have your number removed or updated. Text STOP to the last text you received to stop. ## ClarityPay Service Alerts: By providing your mobile number, as a customer, you agree that we may contact you, via phone call or text, at that number for the purposes of servicing your account. The frequency of these service messages can vary based on activities that warrant such contact, and message and data rates may apply. If you would like to stop receiving account related service messages via text, you may unsubscribe by texting STOP to the last text you received. After unsubscribing you will receive one additional text message confirming that your request has been processed. Text HELP to the last text you received for help or contact us at support@claritypay.com. Consent is not a condition of obtaining a loan. Text STOP to the last text you received to stop. ## Changes to Additional General Provisions **Limitation of Liability** We are not responsible and will not be liable for any damages of any nature, including without limitation any incidental, special or consequential damages (such as lost profits or lost business opportunities), punitive damages or attorney's fees.   **Governing Law** These Mobile Terms are governed by and shall be construed in accordance with Connecticut law (excluding conflicts of law principles).   **Severability** If any term of this Agreement is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.   Last Update: 2024.05.31 ## Questions?
